To implement chapter 11 of the Law on Construction, the Royal Government of Cambodia adopted another Sub-Decree mainly to determine the procedure and conditions for granting, suspending and revoking certificate of construction occupancies. It is now required that every completed construction shall request for certificate of occupancy. Moreover, any completed part in a construction or changing construction function are also required to have the certificate of occupancy except any construction which is not required to have a Construction Permit and all changes of construction component functions that does not increase any load to the construction component or does not change for any business purpose. It is crucial to note that any construction which has been finished and granted the site closing permit before this sub-decree adopted, the site closing permit is equally regarded as certificate of occupancy and no further request is required.
In order to get the certificate of occupancy, applicant shall ensure that the construction is built pursuant to the construction technical regulation and other applicable regulations. Moreover, the construction shall consist of a standardized fire prevention and extinguishment system. Application form for certificate of occupancy shall be submitted to one window service, according to the respective authorities and procedure as provided in the sub-decree on Construction Permit.
Certificate of occupancy can be suspended or revoked based on inspection set in report of construction safety and quality control by competent authorities. Construction safety and quality inspection shall be conducted in every 5 years for non-residential construction, every 10 years for residential construction, every 02 years for fire prevention and extinguishment system and every year for hazardous construction equipment.
The Sub-Decree further requires that each part of the Borey and Co-Owned building project shall submit for the certificate of occupancy which the certificate of occupancy over each private ownership shall be held by the owner and the certificate of occupancy over the common property shall be held by the Management committee.
