Notification No. 020 on Stamp Duty Tax Exemptions and Reduction Measures for First-Time Homebuyers
On December 31, 2024, Cambodia's Ministry of Economy and Finance issued Notification No. 020, introducing stamp duty tax exemptions and relief measures to support first-time homebuyers and stimulate the real estate sector. These incentives are effective from January 1, 2025, to December 31, 2025. Key Provisions: 1. For Properties Purchased Before 2025 (Transferred in 2025): • Full Exemption: For properties valued at or below US$210,000, a stamp duty exemption is granted upon transfer. • Partial Exemption: For properties exceeding USD 210,000, a deduction of USD 210,000 is applied to the taxable base for stamp duty calculation. • Subsequent Properties: For second or subsequent property transfers, a deduction of USD 70,000 from the taxable base is allowed. 2. For Properties Purchased in 2025: • Received the same benefits as the implementation of stamp duty exemptions and relief measures for properties purchased in calendar year 2025 (transferred to subsequent years). Eligibility Criteria: • The property shall be purchased directly from a housing development company that has obtained a development license from the Real Estate and Pawnshop Regulator or the Provincial Department of Economy and Finance. • The purchase price must be based on market value and according to the actual Sale & Purchase Agreement and shall be provided to the tax authority when applying for the transfer of ownership. Additional Notes: • This incentive aims to reduce the tax burden on property buyers and support the growth of the real estate sector in the Kingdom of Cambodia. • Exemptions and reductions do not have retroactive effect on properties that the tax has already been paid.
